MADISON — When a Milwaukee high school teacher surveyed her students on whether they had gotten a COVID shot, she crossed some clear legal lines.
The Wisconsin Institute for Law & Liberty (WILL) promptly called out Milwaukee Public Schools on the breach of student privacy — a violation of federal law and the school system’s own policy.
Rick Esenberg, WILL’s president and general counsel, said the issue isn’t about whether COVID vaccines should be mandated in schools, but about making sure everybody understands and follows the law.
“This is something that simply shouldn’t be happening in public schools, and our goal was to let MPS know that this had happened and ask the people in charge to make sure it doesn’t happen again,” Esenberg told Empower Wisconsin’s M.D. Kittle on Monday’s Jay Weber Show on NewsTalk 1130 WISN.
Esenberg said the district informed WILL it would take the law firm’s warning “under advisement.”
WILL also has filed a lawsuit seeking to stop Dane County’s unelected health director’s countywide indoor mask mandate for individuals 2 and up. Late Friday, the Wisconsin Supreme Court in a 4-3 decision rejected taking original jurisdiction of the case, instead ordering the proper place for the lawsuit is in a lower court. Justice Brian Hagedorn, who ran as a conservative, once again sided with the court’s three liberals in passing on the case.
